Lasting Powers of Attorney (LPA)

FAQs

Common Questions

Do I need both types of LPA?

We recommend making both. A Property & Finance LPA is used while you are alive but lack capacity. A Health & Welfare LPA only takes effect if you lack capacity — covering decisions about care and medical treatment.

What if I lose capacity before making an LPA?

A Court of Protection deputyship order would be required — a significantly more expensive and lengthy process. Making an LPA now avoids this.
